  Distributive Bargaining in Mediation: Thoughts and Alternatives

Description: Distributive bargaining. i.e the trading of numbers back and forth between the parties (plaintiff’s demand and defendant’s offer) is the traditional method employed by Mediators when it comes to settlement negotiations. One side communicates their number to the other side, who hears it, processes it, and reacts to it by sending their number back to the other side. The hope is that the plaintiff continues to lower their demand, the defense continues to increase their offer, and eventually the parties agree on one number.
