After practicing for eighteen years as a Harvard Law School educated, AV rated trial and appellate lawyer, Jay McCauley began converting his practice to full-time mediation and arbitration in 1998. He has obtained extensive training at the Straus Institute for Dispute resolution, has taught three semesters of courses on Dispute Resolution as an Adjunct Professor at Loyola Law School, has written and spoken extensively on the topics of Negotiation Dynamics, Dispute Resolution and Arbitration Advocacy, and has served as a neutral on several hundred matters throughout the state. As a mediator, he handles complex business, employment and real property matters and has been entrusted with resolving large cases, including class actions, and including multiple cases in which the amount in controversy exceeds $50 million. He has earned a reputation for coming to each assignment well prepared, and for applying the resourcefulness, persistence, and integrity needed to be effective. He finds special satisfaction in finding options to resolve cases thought to be intractable. An attorney representing a party in one such case recently wrote, “What a surprise!” then went on to express “thanks and congratulations on a settlement I certainly would never have expected to occur.”


In addition to his work as a mediator, Mr. McCauley also serves as an arbitrator on the large complex case panel of the American Arbitration Association, and serves as a AAA sponsored trainer. He is also an arbitrator on the Independent Administrator panel of Kaiser Permanente. As an arbitrator, he follows the practice of adhering to the ethos of the Rule of Law, in the more congenial and "user friendly" atmosphere of the arbitration hearing.

Finally, in association with Marc Lebed, M.D., Mr. McCauley also provides co-mediation of medical disputes, under the auspices of Medical Dispute Professionals (MDP), an organization that provides experienced physican-lawyer mediator teams dedicated to the resolution of difficult disputes in the medical industry, including medical malpractice actions, intra-staff hospital disputes, and ERISA appeals pertaining to scope of treatment issues.

Background
Mr. McCauley brings to mediation the benefit of his two decades of experience in complex Business, Employment and Real Estate litigation. His Business litigation has included securities fraud class actions, corporate and partnership dissolutions, business valuation, intellectual property, unfair competition, covenants not to compete, theft of trade secret, environmental, insurance coverage, breach of contract and business tort actions. His Employment litigation has included wrongful termination, sex, race and age discrimination, and sexual harassment actions, as well as wage & hour class actions. His Real Estate litigation has included deed of trust, judicial foreclosure, commercial unlawful detainer, breaches of real property sales agreement, brokerage commission and real property valuation actions.
