Lee Jay Berman is one of the leaders in the dispute resolution field. Since founding The Mediation Alliance in 1994, he has successfully mediated over 1,200 cases in his 13 years as a full-time mediator. In addition to being a Fellow with the International Academy of Mediators, he is on the National Panel of Distinguished Neutrals for the International Institute for Conflict Prevention and Resolution (the CPR Institute), the National Roster of Neutrals for the American Arbitration Association (AAA), and the California Academy of Distinguished Neutrals. He is also an International Dispute Resolution Specialist by the United Nations Development Programme.

Lawyers and judges often seek out Lee Jay for training in mediation and negotiation skills. Lee Jay is the Director of “Mediating the Litigated Case”, the flagship training program for the Straus Institute for Dispute Resolution (ranked #1 nationally by US News & World Report) at the Pepperdine University School of Law. Since founding the Institute for Mediation Studies in 1994, he has also taught mediation and negotiation skills for the United States Agency for International Development, AAA, and several bar associations, courts, and Fortune 500 corporations. He is the national chair of the American Bar Association’s Dispute Resolution Training Committee.

In 1999, the Superior Court of Santa Barbara County called on Lee Jay to build and launch their ADR program. To this day, their Court Administered Dispute Resolution (CADRe) Program over which Lee Jay served as Director, serves as a model for other courts across the country.

Today, Lee Jay enjoys a thriving commercial mediation practice, using his vast experience to resolve over 90% of the cases he mediates. His success is largely attributable to his passionate tenacity to help the parties at the table keep working until they have achieved the resolution they sought. Background

A good mediator needs several things – a good understanding of the law, an understanding of business and how decisions are weighed, a feel for numbers and risk analysis, and perhaps above all, people skills. Good mediators are quick studies, needing to grasp the elements of a case and the essence of the relationship (and barriers) between the parties at the table. Good mediators are patient optimists and tenacious problem solvers.

My background is diverse, which I think helps me understand more about the parties at the table. I grew up in a family clothing business, resigning as the President, from which I learned a strong work ethic and leadership skills that a mediator needs. My mediations can often go into the wee hours to settle, when other mediators may have long since given up.

I worked for a division of a Fortune 100 company, which helped me understand corporate decision-making, risk analysis, and the workplace dynamics of people in a rigorous full-time environment. There I learned the dynamics of high-stakes, high-dollar negotiations, overseeing outside counsel in the drafting of contracts often reaching an inch thick. Later, I was a Vice President at the sixth largest homebuilder in the nation.

I became a mediator in 1993 because I found I gravitated to win-win negotiating. Compared to my colleagues, a considerably larger number of my mediations end with collaborative or merger deals as their resolution. Most entertainment cases I have mediated has ended with a joint press release attached as an exhibit to the final settlement agreement, so the parties can promote the product while announcing that they have resolved their dispute.

I strongly believe that every experience I have had in my personal and professional life goes into making me a better mediator. I teach mediation skills to lawyers and judges through Pepperdine’s programs (ranked #1 nationally), because I believe that keeps me fresh as a mediator. My experience and my hope is that one of those tools I have picked up along the way will be the reason that we are able to settle your case when others could not.

Fees
$400.00 per hour, shared by the parties. Also available at $5,000 for an "unlimited day", which includes "unlimited" mediation session, all study and travel time, and expenses. Cases outside of southern California will be billed at daily rate. All fees deposited in advance of mediation.
