Mr. McCauley brings to mediation the benefit of more than three decades of experience in complex Business, Employment and Real Estate litigation. His Business litigation has included securities fraud class actions, corporate and partnership dissolutions, business valuation, intellectual property, unfair competition, covenants not to compete, theft of trade secret, environmental, insurance coverage, breach of contract and business tort actions. His Employment litigation has included wrongful termination, sex, race and age discrimination, and sexual harassment actions, as well as wage & hour class actions. His Real Estate litigation has included deed of trust, judicial foreclosure, commercial unlawful detainer, breaches of real property sales agreement, brokerage commission and real property valuation actions.
John (Jay) McCauley mediates through Judicate West and Arbitrates through the American Arbitration Association and the ICDR. He is an honors graduate of Harvard Law School, a former litigation partner of a large, international law firm, and a Fellow of the College of Commercial Arbitrators and of the Chartered Institute of Arbitrators. He has taught ADR courses over the last decade at Pepperdine, Loyola, UMKC and Creighton Law Schools. He is contributing author of the third edition of the College of Commercial Arbitrators Guide to Best Practices in Arbitration and has been appointed Associate Editor of the fourth edition of that publication. He has been continuously listed for the past eight years as a California Super Lawyer and, for the past seven years, has been included in Best Lawyers in America, in the field of ADR, which named him “Best Lawyer of the Year” in the field of Mediation for the San Jose region in 2013. He specializes in complex business, employment and real property matters, including multiple major matters ranging in value from $10 million to more than $100 million.
