Mediating the Complex Case

This interactive program will focus on how a mediator manages the many moving parts in complex cases.
We will discuss:

A. Identifying the needs, interests and goals of the parties, including:

Multiple defendants fighting over allocation;
Complex facts/data that may involve consultants and/or regulatory agencies;
Insurance carriers raising coverage issues with the insured and disputing allocation with each other.
 

B. Analyzing specific mediation strategies

1. Structuring the negotiations between plaintiffs and defendants

a. Pros and cons of global vs. separate demands
b. Managing the allocation discussion among multiple defendants

2. Managing participation of consultants and/or regulatory agencies

a. Managing the exchange of data in mediation
b. Promoting problem-solving dialogue among consultants

3. Resolving the insurance coverage issues

a. Surfacing the coverage issues
b. Organizing a process to resolve the coverage issues

Getting Past Impasse with Mediator Settlement Recommendations

While it’s preferable for parties to a dispute to settle their own case at mediation without a mediator’s settlement recommendation, a recommendation is useful, as a last resort, to break an impasse. Mitchell will present his “No One Gets Hurt” approach to settlement recommendations in the mediation of civil disputes
